Agreement To Rules
By using BRILLIANTSTAR SOFTWARE's Services / Products, the client agrees to all rules, regulations, and statements made in this usage agreement along with their consequences.
Client's Responsibility
The client alone is responsible of the Services / Product usage and it consequences. BRILLIANTSTAR SOFTWARE reserves rights to change any of its terms and conditions with or without prior notifications. We advise you to regularly check this page.
Unsolicited E-Mail
Here Unsolicited e-mailing practices includes any Spam / Junk / Single Opt-In e-mailing practices. No unsolicited e-mailing practices shall be tolerated. This is to include any practices ascribed to the client, which may or may not involve a BRILLIANTSTAR SOFTWARE's web site hosting, e-mail account, domain hosting account, complete hosting services. This is to include any mass unsolicited e-mailing through the e-mail server / WEB MAGIC INDIA or any other product / property / server of BRILLIANTSTAR SOFTWARE.

Upon reviewing any compaints to any Products / Services of BRILLIANTSTAR SOFTWARE regarding client's unsolicited e- mailing practices, BRILLIANTSTAR SOFTWARE reserves rights to terminate the client's account / website hosting, e-mail account, domain hosting account, and/or other services within 24 hours of notification of the client without refund of website hosting, e-mail account or any service fees which the client may have paid in advance.

Illegal Materials
No use of a BRILLIANTSTAR SOFTWARE's website hosting, e-mail account, domain hosting account, or any other services to promote, sell, trade, or give away the use of the following materials or information shall be tolerated: illegal material or information, stolen material or information, violation of trademarks, pirated material or information.

Upon reviewing any reports received by BRILLIANTSTAR SOFTWARE regarding the client's use of their BRILLIANTSTAR SOFTWARE's website hosting, e-mail account, domain hosting account, or any other services accounts in any of the above practices regarding the addressed (above) material or information, BRILLIANTSTAR SOFTWARE reserves rights to terminate the client's website hosting, e-mail account, domain hosting account, or any other services account within 24 hours of notification of the client without refund of website hosting, e-mail account, domain hosting account, or any other services account fees which the client may have paid in advance.

Explicit Content
No use of BRILLIANTSTAR SOFTWARE's website hosting, e-mail account, domain hosting account, or any other services account to promote material of a sexually explicit or illegal nature shall be tolerated. Let it be known that offensive material falling under the category of "sexually explicit or illegal nature" shall include, but not be limited to the following: any nude pictures of a human being used to exploit, advertise, or sell any product or service; any sort of child pornography, or attempt to display a child in a sexually suggestive manner; any written material describing and/or promoting any sexually explicit, harsh, or abusive acts; any written material which is excessively profane and sexually explicit. Let it be known that at any time BRILLIANTSTAR SOFTWARE reserves rights to judge any material that it deems of an inappropriate adult or sexual nature intolerable for a BRILLIANTSTAR SOFTWARE's website hosting, e-mail account, domain hosting account, or any other services account, thus causing said material to be included under this category of "sexually explicit or illegal nature". Upon reviewing any reports received by BRILLIANTSTAR SOFTWARE regarding the client's use of their BRILLIANTSTAR SOFTWARE's website hosting, e-mail account, domain hosting account, or any other services accounts in any of the above practices regarding the addressed material of a "sexually explicit or illegal nature", BRILLIANTSTAR SOFTWARE reserves rights to terminate the client's web site hosting, e-mail account, domain hosting account, or any other services account within 24 hours of notification of the client without refund of web site hosting, e-mail account, domain hosting account, or any other services account fees which the client may have paid in advance.

Racial/Religious Content
No use of a client's BRILLIANTSTAR SOFTWARE web site hosting, e-mail account, domain hosting account, or any other services account to promote unlawful discrimination against or hatred of any particular race, any particular nationality, or any particular religion shall not be tolerated. Let it be known that at any time BRILLIANTSTAR SOFTWARE reserves rights to judge any material to fall into the above categories, making it unacceptable for a client's BRILLIANTSTAR SOFTWARE web site hosting, e-mail account, domain hosting account, or any other services account. Upon reviewing any reports received by BRILLIANTSTAR SOFTWARE regarding the client's use of their BRILLIANTSTAR SOFTWARE web site hosting, e-mail account, database hosting account or any other services accounts in any of the above practices of promoting unlawful discrimination or hatred of any particular race - any particular nationality - or any particular religion, BRILLIANTSTAR SOFTWARE reserves rights to terminate the client's web site hosting, e-mail account, database hosting account or any other services account within 24 hours of notification of the client without refund of web site hosting, e-mail account, domain hosting account, or any other services account fees which the client may have paid in advance.

Excessive Traffic
BRILLIANTSTAR SOFTWARE does not permit sites where 20% or more of the monthly traffic is from file downloads, or sites that use more than 10% of system resources, or sites which in BRILLIANTSTAR SOFTWARE view are detrimental to the enjoyment of BRILLIANTSTAR SOFTWARE services by BRILLIANTSTAR SOFTWARE other clients, or are in the sole and final judgment of the Host, detrimental to network or business operations, or exceed the account's designated monthly allowed bandwidth usage.

Illegal Account Usage
No use of a client's BRILLIANTSTAR SOFTWARE web site hosting, e-mail account, domain hosting account,or any other services account shall be used for illegal activities, such as, but not limited to: denial of service attacks, port scanning, flooding of services on other servers, and flooding of services on BRILLIANTSTAR SOFTWARE servers. Other attacks not mentioned are also not tolerated, to be decided at the discretion of BRILLIANTSTAR SOFTWARE personnel. BRILLIANTSTAR SOFTWARE reserves rights to immediately deactivate the client's web site hosting, e-mail account, domain hosting account, or any other services account without refund of web site hosting, e-mail account, domain hosting account, or any other services account fees which the client may have paid in advance.

Third party services
If we are giving out third party services like SEO, Google adwords or any other third party and if the concerned party changes their policy we do not remain responsible for that and no refund will be given for the same. You may upgrade the service by paying additional charges if applied. We do not remain answerable or responsible for any problem arising out of changes in terms by third party.

Final Decision
BRILLIANTSTAR SOFTWARE will be the sole and final arbiter as to website accounts, e-mail accounts, domain hosting accounts, any other services accounts or usages of resources that constitute violation or intent to violate our policies. Those users found in violation of these policies are subject to removal for any instance of violation. Accounts which BRILLIANTSTAR SOFTWARE must suspend or cancel due to violation of these rules are not eligible to receive a refund. Acceptance of these Policies constitutes an acceptance of any fines or penalties which might arise out of violation of these policies.

Rule Compliance
Users with website accounts, e-mail accounts, domain hosting accounts, any other services accounts that do not comply with these simple rules, or who seek to take advantage of our unlimited traffic plan in any other way, will, at the discretion of BRILLIANTSTAR SOFTWARE, have their sites canceled and/or removed from the servers and penalty fees assessed at the discretion of BRILLIANTSTAR SOFTWARE.

Right To Judgment
BRILLIANTSTAR SOFTWARE reserves rights to make the judgment call on behalf of our other BRILLIANTSTAR SOFTWARE clients who expect us to maintain our servers at maximum efficiency. We believe this is common sense. If you have any questions about it, please contact us.

Payment Policy
All accounts are set up on a prepay basis. Although BRILLIANTSTAR SOFTWARE reserves rights to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will be notified by an e- mail ( and not by sms and telephonic or any other means of communication ) to renew their services. If they failed to do so then their account will be terminated immediately. If you need any special reminder way, kindly send us Request Letter in the Name of BRILLIANTSTAR SOFTWARE at our head office.

Refund Policy
The Advance paid to BRILLIANTSTAR SOFTWARE covers the cost of design / job / project work carried out. It is not possible to refund a deposit after Seven (7) days or once BRILLIANTSTAR SOFTWARE has sent the first design to the Client or started any kind of process, related to the clients requirement. BRILLIANTSTAR SOFTWARE reserve rights to decide whether a refund is applicable if requested by the Client for any reason. A refund is not guaranteed by BRILLIANTSTAR SOFTWARE, but possible providing BRILLIANTSTAR SOFTWARE decides upon this option. If your account has been cancelled by us due to a breach of the terms and conditions on your part, you will not be eligible for a refund. Phone requests will not constitute acceptance of any cancellation.

Website Design / Software Development and any other Services / Products
BRILLIANTSTAR SOFTWARE job is limited to work / provide services for you or your business. You will be requested to provide all the project related materials in advance. Your project / requirement will be based on the information you provide to us. BRILLIANTSTAR SOFTWARE shall not be responsible for any wrong information provided by you related to your project / requirement.
Minor changes is not guaranteed but can be taken on written request and can be done to the clients project / requirement. Any major changes or additional changes can be done by paying extra charges.
BRILLIANTSTAR SOFTWARE WILL NOT AND SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR INJURY, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM.

Support
BRILLIANTSTAR SOFTWARE is not liable to provide customer support for your e-commerce merchant account or shopping cart / SMS Delivery / 3rd Party Product or Services. You will be advised to seek support directly from these services providers.

BRILLIANTSTAR SOFTWARE is liable to provide support only for Hosting, Web Design, Software Development services you purchased from us.

BRILLIANTSTAR SOFTWARE provides support by Email, Telephonic Call, Remote Desktop Access, Visit at clients place, Clients visit at our office or to meet at any other place and not any other. Any of these support will be given only after mentioning in the Invoice / Quotation / Agreement and client paying for that service.
All Kind of Supports invites Additional Charges.
